Hello Friends!Today we will discuss about Motor Vehicles (Amendment) Act 2019. Motor Vehicles (Amendment) Act 2019 came into effect on September 1, 2019. According to Road, Transport and Highways Ministry half a million accidents are reported in India every year, in which 150,000 people lose their lives. The new law also allows the centre to ask manufactures to recall vehicles in case of defects that cause harm to the environment. The Bill was introduced in Parliament by Road Transport and Highway Ministry in 2016. Let’s discuss about Motor Vehicles (Amendment) Act 2019 in detail.
Aim of Motor Vehicles (Amendment) Act 2019:
This Act aims to make Indian roads safer, reduce corruption and use technology to overhaul the country’s transportation system. The Act focuses on:
1.
Improving Road Transport.
2. Citizen’s facilitation while dealing with
transport department.
3.
Strengthening rural transport.
4.
Last-mile connectivity and public transport.
5.
Automation, computerization and enabling online services.
Accidental Cases in India:
1. According to 2018 report of World Health Organization (WHO) the highest number of road accidents occurs in India worldwide. Even China the most populous country behinds us in this regard.
2.
According to Ministry of Road, Transport and Highways 2017 report there are
about 5 lakh road accidents occurred in India every year in which around 1.5
lakh people are killed.
3.
There are about 1.49 lakh people died in 2018 in road accidents with Uttar
Pradesh registering the maximum spike in fatalities.
Motor Vehicles (Amendment) Act 2019:
Key Features:
Central Government has amended the Motor Vehicles Act 1988. The new rules have been implemented throughout the country from 1 September, 2019. Now the penalty has been increased 10 times on various violations.

Recall of Vehicles: The
new Bill allows Central Government to order for recall of vehicles that are

4. Offence by Juveniles: Now guardian of juveniles/owner of vehicle will be fined Rs. 25000 with imprisonment of 3 Years. Registration of Motor Vehicle shall be cancelled under section 199 of Act.

In case of failure of Motor Vehicles Standard: Fine
up to Rs. 100 crore or imprisonment of up to One Year or both under Section 198
of Act.
6.
Penalty in case of contractor fails to comply with road design Standards: Rs.
1 Lakh…
7.
Section 196 of Motor Vehicles (Amendment) Act 2019: Driving
without insurance fined will be Rs. 2000.
8.
Section 194D of Act: Riding without helmet will be fined Rs. 1000 and
disqualification for 3 months for license.
9.
Section 194B of Act: Driving without seat belt will be fined Rs. 1000.
10.
Section 194E of Act: Not providing way for emergency vehicles will cost Rs.
10,000.
Some new Provisions in Act:
1.
Expiry of Driving License: As
per this new act, an individual can apply for renewal of driving license any
time between one year before its expiry and up to one year after its expiry.
For example: If your driving license is expiring in October, 2020 then you can
apply for renewal from October 2019 till October 2021.
2.
Change in residence address: If
you want to change the residence address or place of business in your driving
license, then you can do it online or you can apply for this to any registering
authority within the state.
3.
Good Samaritan and cashless treatment during Golden Hour: Good
Samaritan is a person that helps road accident victims and renders emergency
assistance to the victim at site of accident. The Act also includes provisions
for cashless treatment of road accident victims during golden hours.
4.
Motor Vehicle Accident Fund: This
fund will provide compulsory insurance cover to all road users in India. The
accident fund will be used for treatment of road accident victims, compensation
to relatives in case of death by road accident.
5.
Cab Aggregators: Under this Act app based Cab Aggregators like Ola and Uber
will be recognized. The aggregators will also be required to comply with
Information Technology Act 2000.
